Terms & Conditions

Use of this website assumes that you fully accept and agree to the Terms and Conditions set forth in this document. These Terms & Conditions also state that by signing up, you are certifying you have read, understand and agree to our Terms & Conditions as well as our Privacy Policy. Our Privacy Policy can be accessed and reviewed here.

MyMagazineClub.com and/or My Magazine Club llc reserves the right, in its sole discretion, to change its Terms & Conditions at any time, for any reason, without notice. We may also add or remove any subscription offer listed at any time. Please check these Terms of Use periodically for changes. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Terms of Use as modified. The last date these Terms of Use were revised is set forth below. If you breach any of these Terms of Use your right to use this Site will terminate automatically.

MyMagazineClub.com and/or My Magazine Club llc is a website that offers trial subscriptions at low introductory rates and is contingent upon the Customer completing an offer and providing a valid credit card or debit card to initiate the subscription. Subscribers will be charged between five cents and ten cents per issues to be received during the trial period, such total amount to be not less than $0.80 or more than $2.00. This initiation fee is never refundable, and represents the total cost to the subscriber for the trial issues to be received. The subscriber may cancel their subscription at any time within 30 days of the initiation charge without further obligation. All issues received by the subscriber during the trial period are the subscriber's to keep.

Club members may cancel their subscriptions at any time after the 30 days and receive a 100% refund an all issues that have not yet been served.

ADDITIONAL TERMS

These terms apply to any and all websites owned and operated by MyMagazineClub.com and/or My Magazine Club llc (collectively, the "Site").

These terms apply to your use of MyMagazineClub.com and/or My Magazine Club llc (the "Site").

I. MEMBERSHIP

1. Valid Information.

(a) All users shall provide accurate information about their identity.

(b) A user must have a valid email, telephone number, mailing address and credit or debit card to qualify for membership at MyMagazineClub.com and/or My Magazine Club llc. Subscribers should note that MyMagazineClub.com and/or My Magazine Club llc reserves the right to limit access to one account per mailing address.

2. Accounts.

(a) Users may not be allowed to take advantage of multiple trial offers. All multiple accounts found to be fraudulent or which violate these Terms and Conditions will be placed on hold.

(b) Only one account may be allowed per shipping address. We do this to ensure quality subscribers for our publishers. Any accounts which is found to contain shared shipping addresses may be placed on hold.

(c) A single user may not have multiple accounts at more than one shipping address. For example, a user may not have an account at a street address and a P.O. Box.

(d) A user may not use another person's name or information to receive trial subscriptions from this website. For example, one person may not accept a trial subscription offer for another person, or complete offers in another person's name.

(e) Each club member is personally responsible for maintaining the security of his or her account. Although our ordering process is secure, club members should be aware of their surroundings and who might have access to their activities on their computer, their network whether at home, at work or in a public place. MyMagazineClub.com and/or My Magazine Club llc is not liable for any losses incurred through the access of your personal data by a third party.

(f) Any visitor to this site who has his or her account placed on hold may not create another account on MyMagazineClub.com and/or My Magazine Club llc. All parties residing at the same physical address as a user on hold may be affected by this rule and thus, may be placed on hold indefinitely.

3. Cancellation of Subscriptions.

To cancel a subscription, please contact Our Club Member Satisfaction Center directly.

4. Security.

Any unauthorized use or entry ("hacking") into MyMagazineClub.com and/or a My Magazine Club llc website is illegal and is punishable by law. Even the slightest violation of any law will provide sufficient reason for us to prosecute the offender to the fullest extent of the law.

II. OFFERS

1. Eligibility

(a) At this time, club members must be residents of the United States with a valid postal address serviceable by the US Post Office, and may only receive trial offers if they are new subscribers to the magazines they have chosen.

(c) In order to receive prompt customer service, a club member must use the same email account that he or she originally used when signing up for the trial offer at MyMagazineClub.com and/or My Magazine Club llc.

2. Failure to be credited for an offer

(a) MyMagazineClub.com and/or My Magazine Club llc does not guarantee that an aspiring club member user will qualify for an featured trial offer. We reserve the right to refuse to fulfill a trial subscription request for a variety of reasons, including, but not limited to, the decline of the charge for the initial initiation fee by your bank or credit card provider, lack of appropriate information including the submission of an invalid mailing address and/or improper sign-up method or other violation of these terms and conditions.

(b) Club Members are responsible for saving all confirmation emails received associated with trial offer completion. A confirmation email is an email that a user receives from MyMagazineClub.com and/or My Magazine Club llc after the successful completion and acceptance of a trial subscription offer by MyMagazineClub.com and/or My Magazine Club llc.

(c) If a club member believes that they have fully completed an offer and yet, has not received an email confirmation, they should make sure that they have in fact met all of the requirements stipulated by the offer. If the club member confirms that they have performed all of the necessary actions, and have waited a sufficiently appropriate period of time yet has not received confirmation of their order, he or she should contact us via our Club Member Satisfaction Center.

3. Terms of Offers

(a) MyMagazineClub.com and/or My Magazine Club llc is not responsible for the terms and conditions of any of the affiliated websites or partner offers on our website. We make an effort to screen our offers to ensure the best possible experience for our users. However, we are not responsible for any ensuing charges or contracts incurred between a user and an offer provider. Users should carefully read the requirements, terms and conditions, privacy policy and billing information for each offer.

(b) All users complete offers through affiliates at their own risk. We are not responsible for services or products associated with our affiliate offer providers. If there is a complaint about services or products received from an affiliate, users should directly contact the offer provider in question.

(c) The offers and their associated requirements on MyMagazineClub.com and/or My Magazine Club llc may change without notice.

(d) The available offers may vary from user to user.

III. ORDERS

1. Receipt of Magazines

(a) After a club member completes the steps required to receive the product, MyMagazineClub.com and/or My Magazine Club llc will take measures to ensure that the user receives their magazines within a reasonable amount of time. Delivery times vary amongst publishers, but most weekly magazines will start within three to five weeks of the date the orders are received, and most monthlies will start within five to eight weeks after the date the order is placed. Bi-monthlies and quarterlies may take longer to start. MyMagazineClub.com and/or My Magazine Club llc guarntees delivery of every last issue.

(b) On occasion, magazines may discontinue publishing. In such cases MyMagazineClub.com and/or My Magazine Club llc will make available a list of magazines that may be substituted, or may refund the unserved portion of the discontinued subscription.

(c) After a club member receives a magazine, if we determine that he or she fraudulently completed the requirements, we have the right to take legal action against the user.

2. Delivery of Product

(a) All subscriptions will be mailed to the address provided by the club member at the time the order is placed. It is a club member's responsibility to verify that the address provided is correct. MyMagazineClub.com and/or My Magazine Club llc is not responsible for lost subscriptions stemming from incorrect shipping addresses, theft, or erroneous deliveries. However, MyMagazineClub.com and/or My Magazine Club llc will gladly correct the delivery address and either extend the subscription or replace the missing issues if available to ensure that the club member receives every last issue that they have ordered. Should the club member's address change during the term of the subscription, MyMagazineClub.com and/or My Magazine Club llc will gladly notify the publishers of the correct address and ensure delivery of all issues ordered.

(b) If a club member does not receive a magazine, he or she should make sure that they have waited the appropriate time period and confirm that the shipping address given is indeed correct. In the event that a magazine is lost, MyMagazineClub.com and/or My Magazine Club llc will make every effort to correct the problem and either replace the missing issues if available or extend the subscription.

(d) If a club member has received multiple trial subscription packages at a shipping address, MyMagazineClub.com and/or My Magazine Club llc has the right, at any time, to refuse future delivery to that address.

3. Cancellation of Orders

A club member may cancel a trial subscription order while it is being processed by contacting us via the Club Member Satisfaction Center.

4. Availability of Product

On occasion, magazines that appear on our website may be back ordered or discontinued by the publisher. In cases involving backordered products, magazines will ship as soon as they are made available. In cases involving discontinued magazines, we will contact you so that you make choose a different magazine or receive a refund on all unserved copies if desired.

IV. FRAUD

1. Incidents of Fraud

(a) MyMagazineClub.com and/or My Magazine Club llc reserves the right to screen all club member applications for signs of fraud. We reserve the right, in our sole discretion, to determine which orders are fraudulent, and to not disclose the reasoning behind this decision.

(b) If suspicion of fraud is found, the user may have his or her account placed on "hold" and would be unable to order any trial subscriptions.

V. HOLD

1. Common Reasons for Being Placed on Hold

(a) Multiple accounts.

(b) Fraudulent transactions.

(c) Incidents of trial offers being completed and immediately canceled.

(d) More than one trial subscription at a club member's shipping address. A club member must have a valid email, mailing address, telephone number and credit or debit card.

(e) Posting information on a website, forum, or auction that has to do with "canceling the trial offers" included, but not limited to, cancellation phone numbers, cancellation time frames, and any encouragement or direction to cancel the offers after signing up with them.

(f) Posting a referral link in places where it is not welcome, or spamming a referral link online in any capacity is strictly prohibited. If we see or receive complaints about such referral methods that we deem risky, we may place your account or accounts on hold.

(h) Purchasing a domain name with the sole intent and purpose of automatically redirecting visitor traffic to MyMagazineClub.com and/or My Magazine Club llc that includes a referral link without the visitors' knowledge.

(i) Any other reason or a combination of reasons at the sole discretion of MyMagazineClub.com and/or My Magazine Club llc

2. Additional terms regarding "hold" status

(a) We reserve the right to place a user's account on hold at any time.

(b) We are not responsible for notifying a user about his or her account being placed on hold.

(c) If an account on MyMagazineClub.com and/or My Magazine Club llc is placed on hold, any other accounts created by that individual may be placed on hold as well. Moreover, all orders from any account created or connected to this individual may be frozen and the user will be unable to order MyMagazineClub.com and/or My Magazine Club llc.

(d) A user who has had his or her account placed on hold may not create another account on MyMagazineClub.com and/or My Magazine Club llc.

(e) A user's account may be placed on hold indefinitely.

(f) If a user feels that he or she has been placed on hold in error (i.e. has not acted against the terms of MyMagazineClub.com and/or My Magazine Club llc), he or she may contact us via our website.

(g) We reserve the right to follow up legally on fraudulent activities.

VI. CUSTOMER SERVICE

1. Contacting Customer Support

(a) Due to the volume of customer service requests, we ask that all questions, comments, and concerns should be sent to us only after reading our entire FAQ/Help page on our website, as many answers to common questions can be found on that page.

(b) Please allow three business days for responses to customer service inquiries.

(c) In order to ensure the preservation of account security and to promote customer service efficiency, club members should only email us using the address with which they signed up for this website.

(d) We reserve the right to block any email address.

VII. OTHER

1. Intellectual Property. MyMagazineClub.com and/or My Magazine Club llc, and all information and/or content that can be seen, heard or otherwise experienced on the Site, including without limitation all reports, text, video, graphics, audio, and other materials (collectively, the "Content") are protected by U.S. and international copyright, trademark and other laws, and belong to MyMagazineClub.com and/or My Magazine Club llc or to third parties.

You may use the Site and the Content solely for your personal or internal use. You may download, print and store portions of the Content that you select for such use. No right, title or interest in any downloaded Content or materials is transferred to you as a result of any such downloading. MyMagazineClub.com and/or My Magazine Club llc reserves complete title and full intellectual property rights in any Content you download from the Site. You may not modify, reformat, copy, reproduce, display, distribute, repost, transmit, publish, license, sell, rent, transfer, or create derivative works from any Content or information obtained from the Site, except as expressly permitted by these Terms and Conditions. You may not mirror or frame the home page or any other pages of the Site on any other web site or web page and may not connect links, including "deep links" to the Site. You may not use a robot, scraper, or other automated means of accessing the Site. You are prohibited from using any of the marks or logos appearing throughout the Site without express written consent from the trademark owner, except as permitted by applicable law.

THIS SITE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. YOU AGREE TO ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND THE CONTENT AND FOR EVALUATING THE ACCURACY, COMPLETENESS AND USEFULNESS OF ALL CONTENT. MyMagazineClub.com and/or My Magazine Club llc and MY MAGAZINE CLUB, llc MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE SITE OR THE CONTENT. MyMagazineClub.com and/or My Magazine Club llc EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT WITH REGARD TO THE SITE, THE SERVICES PROVIDED BY MyMagazineClub.com and/or My Magazine Club llc, AND THE CONTENT.

MyMagazineClub.com and/or My Magazine Club llc DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE CONTENT, OR THAT ANY ERRORS IN THE CONTENT WILL BE CORRECTED. 3. LIMITATION OF LIABILITY.

4. User Conduct. You agree to use the Site only for lawful purposes. You agree not to take any action that might compromise the security of the Site, render the Site inaccessible to others or otherwise cause damage to the Site or the Content. You agree not to add to, subtract from, or otherwise modify the Content. 5. Indemnification. You understand and agree that you are personally responsible for your behavior on the Site. You agree to indemnify, defend and hold harmless MyMagazineClub.com and/or My Magazine Club llc or My Magazine Club llc, its affiliates, licensors, employees, and agents from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, indirect, incidental, consequential, and/or exemplary damages), and reasonable attorneys’ fees, resulting from or arising out of your use, misuse, or inability to use the Site or the Content, or any violation by you of these Terms and Conditions.

6. General Provisions.

a. Enforcement/ Choice of Law/ Choice of Forum. Every provision of these Terms and Conditions will be construed, to the extent possible, so as to be valid and enforceable. If any provision of these Terms and Conditions so construed is held by a court of competent jurisdiction to be invalid, illegal or otherwise unenforceable, such provision will, to the extent so held, be deemed severed from these Terms and Conditions, and all other provisions will remain in full force and effect. Any and all disputes relating to these Terms and Conditions, the Site, your use thereof, or the Content (collectively, "Disputes") are governed by, and will be interpreted in accordance with, the laws of State of Virginia, County of Albemarle, without regard to any conflict of laws provisions. Any Dispute will be venued in a state or federal court situated in the State of Virginia, County of Albemarle, and you hereby irrevocably submit to the personal jurisdiction of such courts for that purpose.

b. Entire Agreement/No Waiver. These Terms and Conditions and the Privacy Policy incorporated herein by reference constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by MyMagazineClub.com and/or My Magazine Club llc or My Magazine Club llc of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default.

c. Correction of Errors and Inaccuracies. The Content may contain typographical errors or other errors or inaccuracies and may not be correct or current. MyMagazineClub.com and/or My Magazine Club llc or My Magazine Club llc reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. MyMagazineClub.com and/or My Magazine Club llc and/or My Magazine Club llc does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.
